GENERAL INFORMATION
The
homes Figure Eight Realty represents are privately owned
and reflect the needs and tastes of their owners. Many reservations
will be made by phone. If you have any particular requirements
or needs, we advise personal inspection of the home prior
to confirming your reservation. Our agents are familiar
with all of the homes we manage and will do their best to
meet your needs if a personal inspection is not possible.
We will not be able to make arrangements for other accommodations
upon your arrival.
A vacation home is just that, a home. Your family and friends
will be able to casually relax in their own living space
without the interruptions found in a crowded resort or hotel.
Guests who dont mind washing their own dishes and
giving up room service will enjoy spending quality vacation
time with family and friends in a home away from home.
Guests are invited to use the tennis courts and boat ramp
located on Beach Road South. There are also bike, beach
equipment, and kayak rentals available at the Yacht Club
Complex. However, we regret that all Yacht Club Facilities,
including the pool and boat slips at the marina, are available
to Yacht Club Members Only. GUESTS ARE NOT PERMITTED TO
BRING JET SKIES, WAVE RUNNERS, OR OTHER SIMILAR PERSONAL
WATERCRAFTS ONTO FIGURE EIGHT ISLAND
RESERVATIONS
Reservations
can be made in person or by phone.
We are sorry; we do not accept credit cards. A $50 reservation
fee will charged on all Rental Agreements.
SECURITY DEPOSIT
A
security deposit in the amount of $400 (this figure may
vary with different properties) is required. Tenants will
be held liable for any damages to the property or furnishings.
All or any portion of the deposit not retained to cover
damages found during inspection will be refunded no later
than forty-five (45) days after your departure date.
CHECK IN TIME IS 4:00 PM
No
early occupancy or keys will be released until 4pm. No possession
will be granted until all outstanding charges have been
paid. Check in location will be at our office which is located
on Figure Eight Island (see location
page at 15 Bridge Road, Wilmington, NC 28411 (1-800-279-6085).
Should you arrive after our office closes, your rental package
will be given to you by the security guard at the Figure
Eight Island gate house.
CHECK OUT TIME IS 10:00 AM
We
must strictly adhere to the stated check out in order to
prepare for the next tenants arrival. NO EXCEPTIONS
WILL BE MADE. All guests must check out by 10:00 AM. Check
out procedures include the following: emptying refrigerators;
disposing of all trash in outside containers; washing all
dishes, cookware, utensils, etc.; emptying dishwasher; and
generally leaving the unit neat and clean. You will be charged
for completing these tasks if they are not performed.
LENGTH OF RENTAL
During
the summer season our rental homes are rented on a weekly
basis from Friday to Friday.
MAXIMUM OCCUPANCY
Figure
Eight Island Associates strictly adheres to each propertys
maximum occupancy as stated. The maximum occupancy includes
tenant, tenants family (including all children, only
children sleeping in cribs are not counted in total occupancy)
and tenants guests. No weddings, receptions, parties
or large gatherings permitted.
NO PET POLICY
PETS
ARE NOT ALLOWED IN ANY OF OUR VACATION PROPERTIES. Violation
of this policy authorizes agent to terminate guests
occupancy of the dwelling and reservation. Guests will forfeit
all rent and will be charged a $200.00 pet fee.
FURNISHINGS AND EQUIPMENT
Linens
(Bedroom and Bath) are not provided, but can be rented at
an additional charge. All units are equipped with heating/air
conditioning, washer/dryers, microwaves and basic housekeeping
accessories including dishes, cookware, flatware and various
small appliances. At least one TV/VCR is provided with each
unit. No repair or replacement will be guaranteed and no
refunds for TV/VCR malfunction. All properties are equipped
with Basic Cable service.
MAINTENANCE
All
equipment should be in proper working order, but you should
promptly report to our rental office anything inoperative.
All efforts will be made to expedite repair but NO REFUNDS
WILL BE MADE. Guests will be charged for unwarranted service
calls.
TELEPHONE CALLS
No
long distance calls may be charged to the vacation residence
telephone number. Lessee will be responsible for any long
distance calls plus a service charge for each call made
to Owner’s telephone number during tenant’s occupancy. Long
distance calls should be made with a calling cards or collect.
RENTAL ITEMS
If
you need additional items such as cribs, high chairs, roll
aways, or bikes, there are several companies in the area
who will deliver these items to your vacation home. Please
contact these vendors
directly at least 2 weeks prior to your arrival.
MAIL AND MESSAGES
Mail
is delivered to the individual properties daily. Mail should
be addressed c/o house name and address, Wilmington, NC
28411. Federal Express also delivers on the island. If you
should need a fax sent to you during your stay, you may
use our office fax (910) 686-1174 for a service fee. The
telephone number for your vacation rental home is stated
on your lease agreement.
HOUSES FOR SALE
From
time to time, certain rental properties may become available
for sale. In the event the property that you are renting
is on the market for sale, Figure Eight Realty reserves
the right to show the property to qualified buyers. We will
make every effort to schedule the showing at a time that
is convenient for you and your guests.
CANCELLATION POLICY
If
you choose to cancel your reservation more than 60 days
before your arrival date, there will be a 50% refund of
your required advance rent payment. If you choose to cancel
your reservation within 60 days of your arrival date, then
your required advance rent payment will be forfeited, unless
covered by travel insurance. The $30.00 reservation fee
and optional insurance premium are NON-REFUNDABLE. Guests
cannot assign or sublet the lease agreement without written
consent of Owner.
In order to protect your vacation investment, please consider
purchasing travel insurance. Information is provided with
your lease agreement. If you have any questions concerning
travel insurance coverage, please call CSA Travel Protection
at 1-800-554-9839. We are not licensed insurance agents
and can not answer questions pertaining to insurance coverage.
TRAVEL
INSURANCE
CSA Travel Insurance
is automatically added to your Rent Request/Lease Agreement.
If you choose not to purchase the travel insurance, you
can decline it by initialing where indicated on your lease
agreement. Travel insurance is optional but strongly recommended.
This insurance helps protect your vacation investment in
case of unforeseen events. A pamphlet describing the coverage
is included with your lease agreement. If you choose not
to purchase this coverage, NO REFUNDS WILL BE GIVEN IN THE
EVENT OF UNFORESEEABLE CANCELLATIONS, INCLUDING HURRICANE
EVACUATIONS. (See Cancellation Policy). Travel insurance
cannot be purchased after your final balance is
received. Travel insurance, once purchased, is non-refundable.
EXPEDITED EVICTION
If
a tenancy is thirty (30) days or less, the expedited eviction
procedures set forth in Article 4 of the VRA will apply.
A tenant may be evicted under the VRA's expedited procedures
if the tenant does any of the following:
1) Holds over possession after tenancy has expired.
2) Has committed a material breach of the terms of the vacation
rental agreement that, according to the terms of the agreement,
results in termination of his or her tenancy.
3) Fails to pay rent as required by the agreement.
4) Has obtained possession of the property by fraud or misrepresentation.
HURRICANE POLICY
If
a mandatory evacuation of Figure Eight Island is issued
by authorities, guests shall comply with the evacuation
order. Travel insurance coverage is your only option for
a refund in the event of a mandatory evacuation. IF YOU
DECLINE INSURANCE, THERE WILL BE NO REFUND. If a voluntary
evacuation is issued and you choose to leave, there is NO
REFUND.
LEGAL/ETHICAL MATTERS
Management
firm and Owner shall be indemnified and held harmless against
any liability for personal injury or property damage sustained
by any person (including tenant’s guests) as a result of
any cause, unless caused by management firm or owner’s negligent
act or failure to comply with obligation imposed by the
VRA. This includes indemnity of personal injury sustained
as a result of use of spa, hot tub, Jacuzzi, swimming pool,
or elevator, if present on property.
Management firm, owner or their representatives have the
right to enter the premises during tenancy to inspect, make
repairs, or show property for sale.
VACATION RENTAL ACT
The
Vacation Rental Act (VRA) provides that if the premises
is voluntarily transferred by the Owner, a Lessee has the
right to enforce the vacation rental agreement against the
grantee of the property if the vacation rental is to end
180 days or less after the date the grantee’s interest in
the property is recorded; if the vacation rental is to end
more than 180 days after the recordation of the grantee’s
interest in the property, the Lessee has no right to enforce
the terms of the agreement unless the grantee agrees in
writing to honor the agreement. If the grantee does not
honor the agreement, the Lessee is entitled to a full refund
of any payments he or she has made. The VRA also provides
that the grantee or grantee’s agent, within ten (10) days
after the transfer of the property shall:
a) Notify each Lessee in writing of the property transfer,
the grantee’s name and address and the date the grantee’s
interest was recorded.
b) Advise each Lessee whether he or she has the right to
occupy the property subject to the terms of the Lease and
the VRA.
c) Advise each Lessee of whether he or she has the right
to receive a refund of any payments made by him or her.
The VRA also provides that upon termination of the Owner’s
interest in the property, whether by sale, assignment, death,
appointment of receiver or otherwise, the Owner, Owner’s
agent, or real estate agent is required to transfer all
advance rent paid by the Lessee (and other fees owed to
third parties not already lawfully disbursed) to the Owner’s
successor-in-interest within thirty (30) days and notify
the Lessee by mail of such transfer and of the transferee’s
name and address. However, if the vacation rental is to
end more than 180 days after the recordation of the Owner’s
successor-in- interest in the property, and the successor-in-interest
has not agreed to honor the vacation rental, all advance
payments paid by Lessee (and other fees paid owed to third
parties no already lawfully disbursed) must be transferred
to the Lessee within thirty (30) days. The VRA also provides
that if the Owner's interest in the property is involuntarily
transferred to another prior to the Lessee's occupancy of
the property, the Owner shall refund to the Lessee any payments
made by the Lessee within sixty (60) days after the transfer.
